This website is operated under the VoltzToys brand by [Voltz Toys Inc. — confirm the legal entity name before launch]. In these Terms of Service, “VoltzToys,” “we,” “us,” and “our” refer to the entity that operates this website.

By accessing or using this website, creating an account, placing an order, purchasing a product, submitting a review, or using any other service offered through the website, you agree to comply with the provisions of these Terms of Service that apply to the relevant activity. When you place an order, you also agree to the applicable specific policies in effect at the time of your order.

If you do not agree to these Terms, do not use this website or place an order.

1. Scope of These Terms

These Terms apply to:

• the official VoltzToys Canada website at voltztoys.ca;
• website accounts, shopping carts, checkout, reviews, customer service, and other related online features; and
• products, parts, gift cards, extended warranties, and other services purchased through this website.

Orders completed through Amazon, Walmart, Best Buy, or another third-party platform are generally also subject to the rules of the applicable platform. If the rules of a third-party platform conflict with these Terms, the appropriate treatment will be determined according to the source of the order, the specific matter, and applicable law.

The following VoltzToys policies form part of these Terms:

• Shipping Policy;
• Return, Refund & Exchange Policy;
• Limited Warranty & Extended Warranty Policy; and
• Privacy Policy.

3. Eligibility and Accounts

You must have reached the age of majority in your province or territory, or use this website with the involvement and consent of a parent or legal guardian.

Purchases, payments, warranty claims, and return or exchange requests must be completed by an adult with the legal capacity required for the relevant transaction.

You agree to:

• provide true, complete, and accurate account, order, payment, and delivery information;
• promptly update your contact information and any other necessary information;
• keep your account login credentials secure;
• not impersonate another person or use another person’s payment method without authorization; and
• accept reasonable responsibility for activities conducted through your account.

If we reasonably suspect that an account is involved in fraud, payment-card fraud, an unauthorized payment, a system attack, or other unlawful activity, we may suspend the relevant account or transaction. Such suspension does not eliminate any obligations arising from an order already formed, a refund, a warranty, or applicable law.

4. Electronic Communications

You agree that we may send transactional communications relating to orders, payments, delivery, pickup, warranties, safety notices, and customer service by email, text message, telephone, through your website account, or by another reasonable method.

Receiving transactional communications does not mean that you automatically consent to receive marketing communications. Marketing emails, text-message subscriptions, and unsubscribe arrangements are governed by our Privacy Policy and applicable law.

Please ensure that the email address and telephone number you provide are accurate and active, and review order and shipping notifications promptly.

5. Product Information and Presentation

We make reasonable efforts to ensure that product titles, models, images, videos, colours, specifications, configurations, prices, inventory information, and other details are accurate.

Product colours, packaging, or non-essential appearance details may vary slightly because of display settings, lighting, photography, production batches, or packaging updates. These variations do not permit us to substitute a different product model or materially change a promised core configuration without the customer’s consent.

The specific product, colour, parts, accessories, and gifts included in an order are determined by the product page, the customer’s selections, the checkout page, and the order confirmation.

If we discover an obvious data-entry, typographical, or system error in product information, pricing, or configuration, we will contact the customer as soon as reasonably possible. We will not increase the price of an order already submitted or substitute a different product without the customer’s express consent. We may refuse or cancel the affected order only where permitted by applicable law and where a contract has not yet been formed. If payment has already been collected, it will be refunded in full to the original payment method.

6. Children’s Products and Safe Use

Some products sold by VoltzToys are children’s ride-on toys, electric vehicles, remote-control toys, models, building sets, or other products that require adult involvement.

Customers must:

• read and follow the product manual, warning labels, and safety instructions;
• assemble, inspect, charge, and maintain the product as required;
• observe all applicable age, weight, seating, voltage, surface, and operating-environment restrictions;
• ensure that children use the product under the supervision of a responsible adult;
• use appropriate safety equipment;
• not use a children’s ride-on toy on public roads, dangerous terrain, or in any environment not expressly permitted for the product; and
• not modify, overload, or misuse the product in a manner that may affect its safety.

Age recommendations on product pages are general guidance. A parent or guardian must still assess the child’s height, weight, abilities, and intended operating environment.

7. Prices, Currency, Taxes, and Promotions

Unless the website clearly states otherwise, prices on the VoltzToys Canada website are shown in Canadian dollars (CAD).

Applicable taxes, delivery charges, and other calculable fees will be displayed during checkout. Other than taxes imposed by law, we will not add a fixed mandatory fee after checkout in a way that prevents a customer from completing a purchase at the advertised price.

Product prices may change based on inventory, promotions, and business conditions. Price changes generally do not apply retroactively to orders that have already been legally formed.

Discount codes, limited-time offers, gifts with purchase, bundles, Price Match offers, member promotions, and other promotions may be subject to separate conditions, including:

• validity dates;
• eligible products;
• minimum purchase requirements;
• usage limits;
• whether the promotion may be combined with other offers; and
• geographic or inventory restrictions.

Unless expressly permitted by the applicable promotion rules, offers generally cannot be redeemed for cash, applied retroactively, or combined with other offers.

We may refuse a promotion obtained through the obvious exploitation of a system vulnerability, duplicate accounts, a false identity, an automated process, or another improper method.

8. Inventory and Purchase Quantities

Adding a product to your shopping cart does not reserve inventory.

Before checkout, we may clearly establish reasonable purchase limits, delivery-area restrictions, or promotional restrictions. We may also review transactions that appear to involve fraud, unauthorized resale, or attempts to circumvent purchase limits.

If an inventory or fulfilment issue arises after an order has been formed, we will contact the customer, explain the circumstances, and provide the applicable options. We will not substitute a different model or materially different configuration without the customer’s consent.

9. Order Submission, Review, and Contract Formation

Before submitting an order, the customer should have an opportunity to review and correct the products, quantities, colours, delivery address, payment method, and order total.

Submitting an order means that the customer is requesting to purchase the products on the terms displayed at checkout. An automatically generated order confirmation records that we have received the order and the related information.

Whether and when an order becomes a binding contract of sale will be determined by applicable law, the checkout page, and the communications relating to the specific order. Nothing in these Terms denies the existence of a contract that has already been formed under applicable law.

Where a contract has not yet been formed and applicable law permits, we may refuse a transaction for any of the following reasons:

• payment was not authorized or failed;
• there are reasonable grounds to suspect fraud, payment-card fraud, or identity theft;
• the delivery address cannot be verified or falls outside the disclosed service area;
• the order violates a clearly disclosed quantity or purchase restriction; or
• the transaction or supply of the product is restricted by law, a safety recall, or a government order.

If we lawfully cancel an order after receiving payment, we will issue a full refund to the original payment method. If an order is cancelled for reasons attributable to VoltzToys, we will not charge any fee that would otherwise apply to a voluntary cancellation requested by the customer.

10. Payment

Available payment methods are those displayed at checkout.

By submitting payment information, you confirm that:

• you are authorized to use the payment method;
• the information submitted is true and accurate; and
• you authorize the relevant payment service providers to process order payments, refunds, and necessary risk-control checks.

Shop Pay, PayPal, credit-card instalment plans, and other third-party payment or financing services may be subject to their own terms. Using a third-party payment service does not alter the responsibilities that VoltzToys has by law as the seller of the products.

11. Order Cancellation

Eligibility for cancellation, the point at which an order is considered shipped, cancellation fees, refund methods, and the treatment of an order after shipment are governed by the Return, Refund & Exchange Policy in effect when the customer placed the order.

Submitting a cancellation request does not mean that the order has been successfully cancelled. Cancellation is complete only when the customer receives a cancellation confirmation from VoltzToys.

If a product has already been transferred to the carrier, the order generally cannot be recalled and will instead be handled under the applicable return rules.

12. Delivery and Store Pickup

Delivery areas, free-delivery requirements, processing times, estimated transit times, remote-area charges, P.O. Box restrictions, incorrect addresses, refused deliveries, carrier proof of delivery, shipping damage, lost packages, and theft after confirmed delivery are governed by the Shipping Policy.

Customers are responsible for:

• providing a complete and accurate delivery address;
• ensuring that the delivery location is suitable for receiving a product of the relevant size;
• reviewing tracking information;
• making reasonable arrangements to receive the order during the estimated delivery period; and
• contacting us promptly after discovering a delivery issue.

Delivery times displayed on the website are generally reasonable estimates and are not absolute guarantees. A delay does not limit any mandatory rights available to the customer under applicable law.

Store-pickup orders must be collected after the customer receives a pickup notice and in accordance with the time, location, and identity-verification requirements stated in that notice.

13. Returns, Exchanges, and Refunds

Order cancellation, return periods, product-condition requirements, unopened-product requirements, RMA requests, Restocking Fees, outbound and return delivery charges, product defects, shipping damage, incorrect items, exchanges, and refund timing are governed by the Return, Refund & Exchange Policy.

Do not return a product unless and until VoltzToys has approved the return and issued an RMA or provided express return instructions.

Non-defective exchanges are generally handled as a return followed by a new order.

A specific return or exchange policy does not limit any non-excludable right to return, cancel, obtain a refund, or pursue another remedy under applicable law.

14. Limited Warranty and Extended Warranty

Any commercial Limited Warranty offered by VoltzToys, and any Extended Warranty purchased separately by the customer, are governed by the product page, the order documentation, and the Warranty Policy in effect at the time of purchase. Those materials determine covered parts, coverage periods, when coverage begins, available remedies, battery benefits, exclusions, claim documentation, and delivery arrangements.

Any replacement-parts process described in a commercial warranty is part of the commercial warranty arrangement offered by VoltzToys. It does not exclude or replace any statutory quality guarantee, reasonable-durability guarantee, or other non-waivable consumer right provided by applicable law.

A paid Extended Warranty is an additional protection service purchased separately. Before purchase, the customer should have an opportunity to review its price, term, coverage, exclusions, and any applicable cancellation rights.

Commercial-warranty eligibility for second-hand products, resold products, and products purchased through third-party or unofficial channels is determined under the Warranty Policy and according to the source of the order, except where applicable law provides otherwise.

15. Pre-Orders, Gift Cards, and Special Services

Production, arrival, and shipping dates displayed for pre-order products are reasonable estimates. If a material change occurs, we will make reasonable efforts to notify the customer and will address any delay or cancellation in accordance with applicable law and the relevant policies.

Gift cards, Store Credit, Extended Warranties, Shipping Protection, Price Match offers, and other special products or services may be subject to separate terms. Customers should review the applicable rules on the relevant page before purchasing or using such a product or service.

Unless otherwise required by law, gift cards and Store Credit cannot be redeemed for cash.

16. Intellectual Property

Trademarks, logos, product photography, videos, text, graphics, page designs, databases, instruction materials, and other content on this website are owned by VoltzToys or the relevant rights holders, or are used under lawful licence.

We grant customers a limited, revocable, non-exclusive, and non-transferable licence to access and use this website solely for personal, non-commercial purposes.

Without written permission, you may not:

• copy, download, sell, or commercially use website content;
• scrape product information, images, prices, or inventory data in bulk;
• remove copyright, trademark, or other proprietary notices;
• impersonate the VoltzToys website, brand, or customer-service personnel; or
• use website content to create a competing product catalogue or database.

Mercedes-Benz, BMW, Ford, Land Rover, BRP Can-Am, and other third-party brands and trademarks belong to their respective owners. VoltzToys’ use of those names does not mean that a brand owner provides any additional warranty beyond what is stated on the applicable product page.

17. Reviews, Photographs, and Other User Content

When you submit a review, photograph, video, question and answer, suggestion, or other content, you confirm that:

• the content is based on a genuine experience;
• you have the right to submit the content;
• the content does not infringe another person’s copyright, trademark, image rights, privacy rights, or other rights;
• the content does not contain false, unlawful, threatening, abusive, malicious, or misleading information; and
• if you received a gift, discount, commission, or other benefit in connection with the review, you will disclose it appropriately.

You retain ownership of your original content. You also grant VoltzToys a non-exclusive, worldwide, royalty-free licence to use that content for display, operations, promotion, translation, and reasonable formatting adjustments.

We may review, hide, or remove content that violates these Terms or applicable law, but we are not required to screen all user content in advance.

18. Third-Party Platforms, Links, and Services

This website is powered by Shopify and may use third-party payment providers, carriers, review platforms, customer-service tools, analytics tools, advertising services, and social-media features.

When you use a third-party website or optional service, that third party’s own terms and privacy policy may also apply.

We do not guarantee the content or availability of third-party websites or services that we cannot reasonably control. Nothing in these Terms, however, relieves VoltzToys of any legal responsibility it has as a seller or as an organization responsible for personal information.

19. Prohibited Conduct

You may not use this website to:

• engage in unlawful activity, fraud, payment-card fraud, identity theft, or abusive chargebacks;
• upload viruses or malicious code, or attack website systems;
• circumvent account, security, payment, inventory, or purchase restrictions;
• scrape, copy, or commercially use website content without authorization;
• manipulate reviews, referrals, discounts, gifts, or promotions;
• infringe the intellectual property rights of VoltzToys or a third party;
• collect, disclose, or misuse another person’s personal information;
• publish unlawful, threatening, discriminatory, harassing, or defamatory content;
• interfere with the normal operation of the website or servers, or another customer’s use of the website; or
• use the website or any product for an unlawful purpose.

20. Privacy and Personal Information

Our collection, use, disclosure, retention, and protection of personal information are governed by the Privacy Policy and applicable privacy laws.

Using this website does not mean that you automatically consent to all non-essential cookies or marketing uses. Available choices and opt-out methods are described in the Privacy Policy and the website’s cookie settings.

21. Website Availability

We make reasonable efforts to maintain the website and its features, but we cannot guarantee that the website will always be uninterrupted, completely secure, or entirely free of technical errors.

We may temporarily restrict access to the website for maintenance, upgrades, security incidents, or other reasonable purposes.

A website interruption or maintenance period does not alter obligations arising from an order already formed, a refund, a warranty, or applicable law.

22. Statutory Rights and Disclaimers

General articles, buying guides, FAQs, and other content that is not specific to a particular product are provided for general information only. They are not a substitute for a product manual, safety warning, or professional advice.

Product sales remain subject to:

• the express descriptions on the applicable product page and in the order;
• the applicable Limited Warranty;
• manufacturer warranties; and
• statutory warranties and consumer rights under applicable law.

Nothing in these Terms excludes, limits, or replaces any right, warranty, guarantee, or remedy under applicable law that cannot be waived by contract.

23. Limitation of Liability

To the maximum extent permitted by applicable law, VoltzToys is not liable for indirect, incidental, special, or consequential pure economic loss resulting from a temporary website interruption, a third-party website, a customer’s failure to follow the product manual, an unauthorized modification, overloading, use in a dangerous environment, or other misuse.

This limitation of liability does not apply to any matter that cannot lawfully be limited or excluded, including:

• death or personal injury;
• fraud or wilful misconduct;
• gross negligence;
• product-safety liability;
• statutory quality and durability guarantees; or
• non-waivable rights under applicable consumer-protection law.

24. Customer Responsibility and Third-Party Claims

If a third party makes a claim against VoltzToys because a customer intentionally used the website unlawfully, infringed third-party rights, submitted infringing content, or materially breached these Terms, the customer will be responsible, to the extent permitted by applicable law, for reasonable losses directly caused by that conduct.

This provision does not require a customer to indemnify VoltzToys for VoltzToys’ own unlawful conduct, wilful misconduct, gross negligence, or any liability that VoltzToys is legally required to bear.

25. Suspension and Termination

We may suspend or terminate a customer’s account or access to the website if the customer materially breaches these Terms, compromises website security, or participates in fraudulent activity.

Suspending or terminating an account does not cancel an order already formed or eliminate any refund, return, warranty, privacy, or other legal obligation.

Provisions relating to intellectual property, liability, user content, and disputes, and any other provisions that by their nature should survive termination, will remain in effect.

26. Events Beyond Reasonable Control

If a delay results from severe weather, a natural disaster, fire, strike, carrier interruption, port congestion, government restriction, war, public-health event, supply-chain disruption, or another event beyond our reasonable control, we will make reasonable efforts to notify affected customers and provide practicable options.

Nothing in this section excludes any mandatory right under applicable law to cancel because of delayed performance, receive a refund, or pursue another remedy.

27. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, website features, policies, or legal requirements.

Updated Terms will be posted on the website with a new “Last Updated” date. Material changes will generally apply to use of the website and orders occurring after the update.

Orders already formed will generally remain subject to the Terms and specific policies in effect when the customer placed the order, unless:

• the law requires a new rule to apply;
• the parties expressly agree otherwise; or
• the updated provision is more favourable to the customer.

We will not use an update to these Terms to retroactively remove a right that a customer has already acquired by law.

28. Governing Law and Dispute Resolution

Without affecting the mandatory legal protections of the consumer’s province or territory, these Terms are generally governed by the federal laws of Canada and the laws of the Province of Ontario.

A dispute may be brought before a court recognized by applicable law and having jurisdiction over the matter. These Terms do not require a customer to waive any right to bring a legal proceeding, participate in a class proceeding, or rely on the jurisdiction of a local court where such a right exists by law. They also do not require a customer to agree to arbitration before a dispute arises.

If a problem arises, we encourage customers to contact VoltzToys first at help@voltztoys.ca so that the parties can try to resolve it promptly.

29. Language Versions

VoltzToys may provide these Terms in English and Canadian French. The different language versions should, to the greatest extent possible, have the same meaning and the same effective date.

For consumers in Quebec, we will provide a French version as required by applicable law. No language version of these Terms limits a customer’s language rights or consumer rights under applicable law.

30. General Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

VoltzToys’ failure to enforce a right immediately does not constitute a waiver of that right.

Section headings are provided for convenience only and do not affect the interpretation of these Terms.

If there is an inconsistency among different documents, it will be addressed in the following order:

1. mandatory provisions of applicable law;
2. the product and transaction terms confirmed in the customer’s order and on the applicable product page;
3. the specific policy governing the matter; and
4. the general provisions of these Terms of Service.

In particular:

• delivery matters are governed by the Shipping Policy;
• cancellations, returns, exchanges, and refunds are governed by the Return, Refund & Exchange Policy;
• product failures, the Limited Warranty, and the Extended Warranty are governed by the Warranty Policy; and
• personal information matters are governed by the Privacy Policy.
